LIMITED WARRANTY AND RETURNS
For a period of one (1) year from the date of purchase, Sutro Connect, 181 2nd Street, San Francisco, California, warrants its Products against defects in materials and workmanship under normal operating conditions. If a Product fails to conform to this Limited Warranty during the Warranty Period, Sutro will, at its sole discretion, either repair or replace any defective Product or component. This is your sole and exclusive remedy for breach of this Limited Warranty. Repair or replacement may be made with a new or refurbished Product or components at Sutro’s sole discretion. If the Product or a component incorporated within it is no longer available, Sutro may in its sole discretion replace the Product with a similar product of similar function. Any Product that has either been repaired or replaced under this Limited Warranty will be covered by the terms of this Limited Warranty for a period of one (1) year after you receive the repaired or replaced Product. This Limited Warranty is not transferable and applies only to the original consumer purchaser. Unless otherwise required by law, any implied warranties are limited to the foregoing warranty periods.
This Limited Warranty does not cover the following (collectively “Ineligible Products”): (i) Products marked as “sample” or “Not for Sale”, or sold “AS IS”; (ii) Products that have been subject to: (a) modifications, alterations, tampering, or improper maintenance or repairs, including but not limited to replacing parts, making cosmetic changes to the Product, replacing any software or firmware, or other unauthorized changes; (b) handling, storage, installation, testing, or use not in accordance with the manual or any instructions provided by Sutro; (c) normal wear and tear; (d) accidental damage; (e) abuse or misuse of the Product; (f) breakdowns, fluctuations, or interruptions in electric power or the telecommunications network; or (g) Acts of God, including but not limited to lightning, flood, tornado, earthquake, or hurricane; or (iii) any non-Sutro branded hardware products, even if packaged or sold with Sutro hardware. This Limited Warranty does not cover consumable parts, including batteries, unless damage is due to defects in materials or workmanship of the Product, or software (even if packaged or sold with the product). Sutro recommends that you use only authorized service providers for maintenance or repair. Unauthorized use of the Product or software can impair the Product’s performance and will invalidate this Limited Warranty.
UNLESS OTHERWISE REQUIRED BY LAW, IN NO EVENT SHALL SUTRO BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE LICENSED APPLICATION, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF SUTRO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Before making a claim under this Limited Warranty, the owner of the Product must (a) call 1-415-480-3663 or visit email@example.com during the Warranty Period to provide notice of your warranty claim and describe the alleged failure, and (b) comply with Sutro’s return shipping instructions. You must obtain prior authorization for your warranty claim before shipping any Product to Sutro and provide proof of purchase, and satisfy all other terms and restrictions set forth in this Limited Warranty. Sutro will have no warranty obligations with respect to a returned Product if it determines, in its reasonable discretion after examination of the returned Product, that the Product is an Ineligible Product (defined below). Sutro will bear all costs of return shipping to owner and will reimburse any shipping costs incurred by the owner, except with respect to any Ineligible Product, for which the owner will bear all shipping costs.
This warranty gives you specific legal rights, and you may also have other legal rights which vary from State to State.
